General Terms and Conditions (GTC) for ocean voyages with skipper Tommy Bieri
These General Terms and Conditions govern the booking and execution of ocean cruises with Tommy Bieri (hereinafter referred to as ‘Skipper’).
1. Subject matter of the contract
The Skipper offers guided sailing trips at sea. The exact route, duration and services available on board are discussed individually with the customer before each trip and recorded in writing (trip agreement).
2. Booking and payment

Enquiry and offer: Customers can make a non-binding enquiry for a trip. The skipper then prepares an individual offer detailing the costs, the period and the planned route.

Conclusion of contract: The contract is concluded as soon as the customer accepts the offer in writing and pays the deposit specified in the trip agreement.

Terms of payment: The exact payment deadlines and terms (deposit, final payment) are specified in the trip agreement. As a rule, a deposit is due upon conclusion of the contract and the remaining payment before the start of the trip.

Prices: The prices quoted are per person or per yacht (depending on the offer) and include the services explicitly listed in the trip agreement. As a rule, travel costs to and from the destination, meals ashore, harbour fees (unless otherwise agreed), diesel costs and personal expenses are not included.
3. Duties and rights of the skipper

Safety responsibility: The skipper is responsible for the safety of the crew and the vessel. His instructions regarding safety, navigation and life on board are binding.

Route adjustments: Especially in tidal waters such as Brittany, weather conditions, tides and unforeseen circumstances (e.g. technical defects) may require an adjustment of the planned route. The skipper is entitled to adjust the route to protect the crew and the vessel or to cancel the trip. There is no entitlement to a specific route or to reaching specific ports.

Cancellation of the trip: In the event of gross misconduct by a participant that endangers safety on board or significantly disrupts the trip, the skipper is entitled to exclude the participant in question from the trip. In this case, there is no entitlement to a refund of the trip fee.
4. Obligations and rights of the customer

Assistance on board: The customer undertakes to follow the skipper's instructions and, within the scope of their capabilities, to assist with any work that needs to be done on board (e.g. handling lines, tidying up).

State of health: The customer assures that their state of health allows them to participate in a sailing trip. If there are any concerns, medical advice should be sought in advance.

Personal responsibility: Participation in the trip is at your own risk. The customer is responsible for their own personal belongings.
5. Cancellation and rebooking

Cancellation by the customer: If the customer cancels the contract, cancellation fees may apply. The exact amount of the fees is specified in the trip agreement and depends on the time of cancellation. It is recommended that you take out travel cancellation insurance.

Cancellation by the skipper: The skipper reserves the right to cancel a trip for important reasons (e.g. force majeure, extreme weather conditions, serious technical problems with the ship, insufficient number of participants). In this case, payments already made will be refunded in full. The customer shall have no further claims (e.g. for travel expenses).
6. Liability

Liability of the skipper: The skipper shall be liable within the scope of the statutory provisions for damages caused by intent or gross negligence on his part. Any further liability, in particular for slight negligence, is excluded.

Liability of the customer: The customer is liable for damage to the boat or its equipment caused by him intentionally or through gross negligence.

We collect and process personal data only to the extent necessary to carry out and process your trip booking and to communicate with you. This usually includes:

Cruise-related data: Information about your booking, such as cruise period and any preferences.
3. Purpose of data processing
Your data will be used exclusively for the following purposes:

Contract processing: To process your booking request, create the cruise agreement and carry out the booked cruise.

Communication: To contact you regarding your booking, trip preparation and trip execution.
4. Data transfer to third parties
Your personal data will not be passed on to third parties unless this is absolutely necessary for the fulfilment of the contract (e.g. when reporting to port authorities, if required by law) or you have expressly consented to this.

We use technical and organisational security measures to protect your data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security measures are continuously improved in line with technological developments.
6. Storage period
Your personal data will only be stored for as long as is necessary to fulfil the purpose of the data collection or as required by statutory retention periods.
7. Your rights as a data subject
You have the right to obtain information at any time about the data we have stored about you, its origin and recipients, and the purpose of data processing. You also have the right to have your data corrected, blocked or deleted. Please contact us directly for this purpose.
Important information about the trip and cabin occupancy
Personal meeting before the trip
All important and individual details about your ocean cruise, including the exact route, safety regulations on board, catering and other practical information, will be discussed with you personally and in detail before the start of the cruise. This allows us to answer your questions and ensure that you are well prepared for the adventure.
Cabin occupancy
In order to ensure the privacy and comfort of all guests, strict attention is paid to cabin occupancy to ensure that unrelated women and men are not accommodated in the same cabin. Single travellers will, where possible, be accommodated in their own cabin or share a cabin exclusively with a person of the same sex. Couples or friends booking together will, of course, be placed together in one cabin.
